Ventura County Criminal Defense Lawyers | California Misdemeanors, Petty Theft & Property Crimes

One of our goals in representing defendants charged with serious crimes is to negotiate to a misdemeanor guilty plea whenever the evidence in the case indicates that trial on the original charges presents an unacceptable risk of a guilty verdict. We also defend clients on charges originally charged as misdemeanors, which in some situations, as in excessive traffic tickets, can themselves present harsh consequences for the defendant. For further information about our misdemeanor defense services, contact a Southern California criminal defense attorney at Bamieh & Erickson, PLC in Ventura.

Car AccidentsAttention Car Accident Victims: You have rights after an accident.

The Florida No-Fault Law (also known as PIP) applies to anyone who is a pedestrian and anyone operating, while a passenger in, or getting in or out of a car or truck. As a result, there is usually a readily available source of money to pay your medical bills and lost wages after a crash. However, if PIP is applicable to your car or truck accident, and in Florida it usually is applicable, you have the right to seek compensation for your injury in court by proving a permanent injury to your body has occurred. A permanent injury can be proven by testimony from your treating physician, showing the loss of a limb, loss of eyesight, scarring or any other permanent loss of an important bodily function. Wrongful death cases are discussed below and special laws and time limits apply to them.

Miami Construction Accident Attorney :: Construction Site Injuries :: North Miami Beach, Florida Construction Injury Lawyer

Construction injuries are those accidents that occur at a construction site. They can occur from machinery malfunctions, handling heavy or awkward loads, making repetitive movements, to name just a few. Injuries vary widely and can affect any part of the body including the neck, back, wrists (carpal tunnel), shoulders, knees, feet, etc. As with all types of injuries, the most important thing to do is to report any injuries you may suffer on the construction site directly to your supervisor as soon as possible so that a Notice of Injury can be filed. Even if you don't need immediate medical attention, your accident should be reported immediately. An injured worker has 30 days to report an accident but the earlier it is reported the better. That way if medical attention is required later, you have met the reporting requirements and should not be denied treatment.

Construction Injury Attorney

In the workplace, accidents are unavoidable, most especially in an environment such as a construction site. According to AOL Jobs, construction workers have a fatality rate of 35 out of every 100,000, as of the year 2006.

As the US Bureau of Labor Statistics reports, in the state ofalone, there are more than 7 million workers in the construction industry as of the same year. As many other sources say, most men brave the dangers of construction jobs, because the pay is much higher per hour as compared to other occupations. However, if you suddenly become unlucky and encounter a mishap at your site, what should you do?

Miami Construction Accident Attorney :: Construction Site Injuries :: Fort Lauderdale, Florida Wrongful Death Lawyer

OJ Simpson Lawyer Explains What's REALLY Going On Behind The Scenes At The DSK Trial

"[The maid and her lawyer] may want to see justice done, but ultimately, money is more important," he told Le Figaro.

He also decoded what the news stories about each side's strategy REALLY mean. In the news, the maid's defense team and DSK's defense team might sound like they're enemies. Really, though, the maid's lawyer is probably negotiating a settlement with DSK's defense right now. And those news stories are just part of the negotiations.

Clarence Thomas takes hard line on defendants

WASHINGTON — Twenty years ago, when a senator asked then-appellate Judge Clarence Thomas why he wanted to be on the Supreme Court, Thomas said he often looked out his courthouse window at arriving prisoners and said to himself, "But for the grace of God, there go I."

During his confirmation hearing, Thomas explained that he would identify with defendants: "So I can walk in their shoes and I could bring something different to the court."

Today, a court in San Francisco heard arguments about one of the most contemptible legal claims advanced in decades: that Vaughn Walker, the federal judge who voted last spring to strike down California's ban on gay marriage , was too gay to decide the case fairly.

ObamaCare Has No Place in a Limited Government

A century ago, the idea that the Constitution imposes limits on the federal government’s authority and that judges have a duty to enforce those limits would have been seen as a truism, regardless of one’s political affiliation.  Yet today, this cornerstone of constitutionally limited government is under attack not just by those on the left, but by conservatives as well.

Watchdog takes over complaints against lawyers | UK news | The Guardian

The Law Society and the Bar Council will lose their powers to investigate complaints against lawyers in England and Wales under a package of radical reforms announced yesterday by the lord chancellor, Lord Falconer.

A single complaints body independent of the profession, the Office for Legal Complaints, will handle all consumer complaints against barristers, solicitors and a range of other legal professionals, including licensed conveyancers and legal executives.

Complaints Rise Against Immigration Lawyers

Complex Statutes, Criminal Schemes Heighten Concerns

Complaints against immigration lawyers working in and around the nation's capital are rising, say officials who investigate allegations of attorney misconduct.

Last year, the D.C. Office of Bar Counsel received 59 complaints about immigration lawyers, up from 49 in 2005 -- when, for the first time, immigration law drew more complaints than any other specialized practice area.

Palin Email Dump A Prelude To Battle Over Private Messages

As Alaska officials release 24,000-plus pages of emails sent and received by then-Gov. Sarah Palin during her half-term in office, at least one person is viewing the spectacle as something of a yawn.

"My prediction is that you will find that, after all this commotion, it will be a bunch of nothing," says Anchorage lawyer Donald Mitchell.

Anniston Star - Reforms that improved Alabama

As a small business owner, I was dismayed to read the recent Star editorial renouncing new tort-reform laws (“Open for business in Alabama,” June 7). The Star’s normally keen reasoning seems to have temporarily departed faster than justice leaving the notorious Sonny Hornsby/Terry Butts kangaroo State Supreme Court, which trial lawyers rode like a horse and milked like a cow. Trial lawyers ruled the Alabama Supreme Court roughly from 1987 until 2000.

Ryan Widmer: 'I'll never give up' | CommunityPress.com | cincinnati.com

In a state prison near Lebanon, Ryan Widmer lies awake, in disbelief that anyone could think he is some sort of criminal mastermind.

"I mean, I'm a regular guy, but yet one night I grow into the perfect assassin? That's really what they're trying to make me out to be," Widmer said.

If he had killed his wife, Sarah, when she drowned in the couple's suburban bathroom in 2008, he would have pulled off a near-perfect crime, he said.

The Persecution of John Edwards

John Edwards is a vain, lying scum who cheated on his wife while she was dying of cancer. But one thing far worse than his contemptible conduct is the government’s effort to put him in jail for it.

In this case, prosecutors are exploiting a vague, confusing law to criminalize conduct that has not been treated as a crime before. The only good news is that its prosecution is so ill-founded and over the top that it is likely to fail.

Permanent Ink: Arrests in the Digital Age - Bethel, CT Patch

The permanence of Internet records and quick access to names listed in police blotters through search engines is complicating the way arrest information is disseminated and stored, according to legislators, lawyers and media experts.

Prior to the Web, those searching for arrest records had to sort through paper or microfilm records at newspapers, libraries or police department records rooms. Today, with a single click on Google, job recruiters, university admissions officials, neighbors and colleagues can pick up a wealth of information on individuals—such as arrest records, including charges listed in cases that subsequently were thrown out.

Face facts on social media - Business - TheSunNews.com

The employer fired the original author for violating a company policy that barred employees from depicting the company "in any way" on social media.

Workers' comp measure a step in right direction

The workers’ compensation reform package approved by the General Assembly should be considered a beginning, not a time for unfurling a “mission accomplished” banner.

The package is a good first step toward controlling costs. But it is only a first step.

The biggest move is a 30 percent reduction in the medical fee schedule for doctors. That still leaves Illinois with among the highest compensation rates in the country.

: How could a man who worked all his adult life in state and local government die rich?

At the time of his death in April at age 89, the former Baltimore mayor, Maryland governor and comptroller had an estate worth nearly $2.5 million.

Frankly, given Schaefer's long career and modest lifestyle, accumulating millions would be easy. Schaefer had a good salary, generous pensions and worked up until age 85 — a couple of decades longer than most people. He was famously frugal and invested his savings. And he also avoided some of life's big expenses, such as divorce or children.

When Do I Need a Personal Injury Lawyer?

f you have been injured due to someone else's negligence or reckless behavior, you will need a personal injury lawyer to determine if you have a valid legal claim.

ORLANDO, FL, June 09, 2011 /24-7PressRelease/ -- If you have been injured due to someone else's negligence or reckless behavior, you will need a personal injury lawyer to determine if you have a valid legal claim. Most personal injury attorneys offer a free consultation. At the consultation, the personal injury lawyer will listen to the details of your claim and look at any medical reports you have. He or she will then determine if you have a valid claim. Most types of accidents and injuries have time limits called a statute of limitations, so you only have a certain amount of time to file suit after the injury or accident occurs. The time limits vary from state, so it is in your best interest to contact an attorney as soon as possible.

Don't let president's verbal misdirections fool you into believing he supports the deportation of illegal immigrants

For decades, one of the most challenging problems facing activists who favor lower immigration levels is “stealth amnesty.” Broadly defined, that means administrations dating back as far as President George H.W. Bush and continuing through President Barack Obama’s , have willfully ignored illegal immigration and allowed aliens to live openly, take jobs, start families and enroll their children in public school with little fear of deportation.

Group Wants to Abolish Soho's Artist-in-Residence Law

It reared its artsy head again late last year: the Soho artist-in-residence zoning law , which made way for the residential conversion of about 200 commercial lofts decades ago on the condition that each converted apartment contain a certified artist. The rule went unheeded for years, until stricter lending standards made it matter again. The Department of Cultural Affairs began rejecting some artists who applied under the rule, and the Department of Buildings decided not to renew some temporary certificates of occupancy that had been granted to buildings without a certified artist in each unit. So where do things stand now with Soho's loftpocalypse?

A Weekly Round-Up of Small-Business News - NYTimes.com

What’s affecting me, my clients and other small-business owners this week.

IS THE SKY FALLING? Our economic problems continue to linger. Private sector hiring and consumer confidence slumped in May. Manufacturing growth is the slowest since 2009. Michael Laparie, political blogger, confirms that the economy “officially stinks.” He says, “I believe that high unemployment, which stems from the uncertainty that is currently undermining the confidence of small to mid-sized businesses, should be the No. 1 issue for Republicans in the 2012 elections.” Intuit’s Small Business Employment Index shows slow growth in May. The share of the population on food stamps grows in most states. Family income numbers make Greg Mankiw pessimistic. The Chicago Fed reports a cooling of business activity. Wall Street begins to panic. Snooki has a tough week. E.J. Dionne says we have an imagination deficit. Greece teeters on the brink (but if this guy isn’t concerned why should we be?).

Rachel 'Bunny' Mellon.

One of the most telling details in today’s indictment of two-time presidential candidate John Edwards comes in the form of a note from a supporter, sent to former aide Andrew Young in 2007. The donor is described in the indictment as ‘Person C’, but is widely understood to be reclusive banking heiress Rachel Mellon, or ‘Bunny’ to her friends. In the note, Mellon, aged 96 at the time, defends Edwards from media ribbing (he’d just spent $400 on a haircut) — and appears to provide evidence that led to today’s indictment for receiving illegal campaign contributions:

SUMMARY JUDGMENTS: Our daily legal-news aggregator for June 3

FDA insider-trading probe expands : A Justice Department investigation of stock trades based on inside information from the Food and Drug Administration is widening beyond the government scientist charged two months ago in the case, the Wall Street Journal reported. The DOJ and the Securities and Exchange Commission originally suggested any illegal activity was limited to FDA chemist Cheng Yi Liang and his son. But people familiar with the matter told the Journal officials are now seeking information from a second FDA scientist and believe the Liangs' activities involved other federal employees. Agency approval or disapproval of a drug or medical device can cause stocks to rise or fall precipitously, making advance knowledge of such announcements a highly lucrative – if blatantly illegal – piece of financial information.

Immigration News

In a landmark decision that has broad implications for immigration enforcement at the state level, the United States Supreme Court Thursday upheld the Arizona Legal Workers Act. Passed  in 2007. The Act has two major components: (1) it requires Arizona employers to use the federal E-Verify system; and (2) it allows Arizona to suspend or revoke the business licenses of employers who knowingly hire illegal aliens. The Chamber of Commerce filed a lawsuit in 2007 seeking to strike down the Arizona law, arguing that both provisions were preempted by federal law.  However, in Thursday’s 5-3 decision in Chamber of Commerce v. Whiting, the Supreme Court rejected the Chamber’s arguments and held that Arizona’s law is constitutional.

No, your concern over your gut reaction to the lawyer you talked to does not sound "weird" at all.  In fact, I applaud you for listening to your gut and moving on. I have no idea what type of injury you suffered and how that injury continues to impact your life, but dealing with these issues can, I know, be stressful.  Now, on top of dealing with your injury, you are adding the stress of trying to sue a person and possibly a medical institution.

Auto Accident Attorney: Pre Consultation Guide When Injured in Car Accident

For things like auto accident related injury which happens about once or twice, or hopefully never, in the lifetime, we do not think about it too much. But if it does happen, it would be good to know what to expect and how to handle it.

The sneaky part about getting injured in a car accident or truck accident is that you may not realize you are hurt and some of the symptoms won't show up until at much later date. When you were hit from behind, a typical injury would be whiplash injury that's when your neck and spinal cord get shaken violently when hit from behind, and you may feel a little dizzy at the scene but it can get much worse. Or your internal organs get shifted, and bumped to each other and cause bleeding, even partial failure, you may not feel a thing until it propagates to other part of the body. The point is your body is a very delicate machine and it can break down in a very subtle way. That's why it is paramount to have an experienced accident lawyer on your side.

What Now for the Unraptured?

I’m still here. I wasn’t raptured away on Saturday, to spend eternity strumming harps and swapping self–congratulatory stories with others of the elect about how we had perfected our retirement portfolios to maximize income despite the coming tribulations of the end times. So I’m going to have to suffer the consequences of not having been saved.

Mr. Strauss-Kahn, accused of sexually assaulting a hotel maid earlier this month, will be forbidden to leave a New York City apartment for all but a few situations. The arrangement calls for at least one armed guard to keep him under close surveillance 24 hours a day, seven-days a week—all at Mr. Strauss-Kahn's expense.

Why judges need to talk to kids

Get over it. That was family law specialist Alf MamoÂ’s implicit message to judges who still refuse to speak with children ages 12 or older in custody or access matters, despite those children being willing and able to speak with the court.

Mamo, of McKenzie Lake Lawyers in London, Ont., spoke at the Annual Institute of Family Law in Ottawa, sponsored by the Carleton County Law Association. The one-day conference on April 8 also featured useful advice on advocacy from Ottawa’s four “core” Ontario Superior Court Family Branch judges, including its new administrative judge, who delivered the eye-opening news that because of the deluge of family cases, she and her colleagues often have only 7.5 minutes “per side” of a case to read and prepare for a motion, and 15 minutes per side to prepare for a settlement conference.
