The trial for an Erie man accused of killing a 24-year-old woman in a drunken driving crash in August has been postponed until September.
Eugene Metzger, 54, had been scheduled to face trial in July in connection with the Aug. 30 accident that claimed the life of Magen Porter. Porter was the passenger on a motorcycle driven by her 25-year-old boyfriend, Jamie Wilt, who was also seriously injured when police said Metzger's sport utility vehicle collided with the motorcycle at the intersection of East 38th Street and Nancy Drive. Wilt committed suicide on March 21.
The parties met briefly Friday in Judge John Garhart's courtroom to argue over whether Assistant District Attorney Mark Richmond may present Wilt's preliminary hearing testimony to jurors. Metzger's lawyer, Paul Susko, is seeking to bar the evidence because his client will not have the opportunity to cross-examine the now-deceased Wilt.
Garhart said he would rule on the matter at a later date. Metzger faces charges including homicide by vehicle while driving under the influence, aggravated assault while DUI, recklessly endangering another person, and involuntary manslaughter.
