Special Rules for Florida Car Accidents :

Florida Fault : No Fault, meaning your insurance will cover damages you sustain in an accident (up to your policy limits), but restricts your recovery from another party unless you meet a high threshold level of injury. Pure Comparative Fault, meaning that courts can reduce any damage award you may receive by the percentage you were at fault for an accident. For example, if you sue for $10,000 in damages but were 10% responsible for the accident, your award will be $9,000.

Florida Car Insurance Requirements/Limits—Bodily Injury & Property Damage Liability : Minimum coverage by law is: $10,000 for property damage and $20,000 for personal injury coverage for all persons in the car at the time of the accident, with a limit of $10,000 for any one individual.

Florida Personal Injury Statute of Limitations : Four years from the date of the injury. Lawsuits for wrongful death must be filed within two years of the accident.

Florida Auto Accidents Involving Government Vehicles : Notice to File Against Government: If you were injured in a car accident caused by a government employee, you may sue the government agency —the city or town, county or state, public agency, school—that employs that person .

For claims against the federal government use form 95 and follow the instructions on page 2.

For claims against the state of Florida, find the proper state agency you believe to be responsible for your accident and contact them to determine their claims process.

In dealing with accidents involving government entities and workers, be aware that there are special notices that must be filed against the government unit responsible for your injury. These notices must be made within a certain time period (30 days to 180 days) and BEFORE filing a lawsuit. Each government entity (city, county, state) has its own separate time period and may differ from the state’s Statute of Limitations against private parties. Accident claims involving the government can be complicated and any mistakes in filing could result in losing your ability to recover for your damages and injuries. Florida Personal Injury Venue (Where to File Lawsuit) : There are several options in filing a lawsuit. You can file in the county court (claims less than $15,000) or circuit court (claims greater than $15,000) located where the accident occurred or where the defendant (the person you are suing) lives or does business. If you are filing a claim against a government agency and are unsure of which agency is responsible, the most prudent course is to file a separate claim against each.
