Metra to Pay $1.45 Million to Woman as Compensation In Chicago Personal Injury CLaim

In a Chicago personal injury claim, Metra, a Chicago railway corporation, has recently consented to pay $1.45 million to Catherine Kozi-O’Donnell in compensation for the injuries she suffered as a result of a September 17, 2005 train derailment accident that resulted in 2 deaths and 117 injured in Illinois.

Kozi-O’Donnell suffered injuries to her leg which required corrective surgery for treatment. She also had to undergo knee replacement surgery as a result of her injuries.

The runaway double-decker train then collided with a steel bridge. It was five miles away from the LaSalle Street Station.  The resulting impact resulted in the deaths of 22-year old Jane Cuthbert and 38-year old Allison Walsh.

The Metra train was traveling from Joliet to Chicago along the Rock Island Line at the time of the accident.  The investigation, conducted by the National Transportation Safety Board (NTSB), also concluded that Metra was guilty of not implementing an automated control system that could eliminate such human errors.  A series of Chicago personal injury claims were soon filed against Metra shortly after the accident. A number of these Chicago personal injury claims have been settled to date.

Renea Poppel, another victim of the September 17, 2005 derailment accident, was awarded $29.5 million dollars by a jury for her Chicago personal injury claim.  She suffered traumatic neural damage, as a result of an impact to the head, as well as a broken neck, a crushed pelvis, vision problems and a fractured arm. Poppel, who was pregnant at the time of the accident, also had to give birth whilst still hospitalized.
