Saw this in the Chicago Daily Law Bulletin recently. It's a summary of discipline against unethical attorneys. A lot of people believe that a lawyer can't lose their license, especially since in Illinois lawyers police lawyers. But the reality is that while there are many scummy attorneys walking our streets, many do get in trouble as you can see for yourself at www.iardc.org. Per this article, 11 attorneys just lost their license and 33 more were suspended. Hopefully none of them were your lawyer.

During oral arguments Wednesday, E. Joshua Rosenkranz told the Ohio Supreme Court the case brought by DirecTV Inc. and EchoStar Satellite Corp. is about fair competition with cable, not getting back more than $300 million in Ohio taxes collected from satellite customers since 2003.

Accutane Lawsuits Continue to Pile Up
New Accutane lawsuits are continuing to pour into a mass tort in New Jersey state court, as more and more plaintiffs file claims alleging that the acne drug caused them to develop inflammatory bowel disease (IBD) .
Well over 400 lawsuits over Accutane have been filed in just the past two months according to the most recent case list provided by the New Jersey courts. The influx of cases brings the total number of New Jersey state court lawsuits over the acne drug to nearly 1,600. All were filed by plaintiffs who claim that Roche failed to adequately warn users about potential Accutane side effects, including the risk of IBD, ulcerative colitis and Crohn’s disease.
Average local wages beat nationwide earnings
The average Philadelphia-area worker is outearning his counterparts nationwide, beating the national average by $1.17 an hour, according to a report issued Tuesday by the U.S. Labor Department.
Workers in the region earned an average of $23.53 an hour, with surgeons and physicians earning the most.
Nationally, the average wage was $22.36 an hour.

What to do about state pensions
Yesterday's post on state pension plans emphasized the problems with spinning the state fiscal crunch into a morality tale of greedy public employees and weak-kneed state legislators. That's useful for Republicans who want to score some points against unions, but it's not an accurate description of the situation, and it doesn't get us nearer to solutions. But though the pension problem is a long-term problem and not behind the current fiscal woes of states, and though it's not as big as the health-care problem, it does need to be solved.

Cape Girardeau lawyer accused of assault pleads guilty to reduced charge
Four felony charges, including two counts of domestic assault and armed criminal action, were dismissed Wednesday at the Common Pleas Courthouse in Cape Girardeau against an area criminal lawyer after he pleaded guilty to a misdemeanor assault charge.

Despite objections, Senate panel approves new judges
HARRISBURG -- The state Senate is moving ahead on the confirmation of two new Common Pleas Court judges, including one in Washington County, even though Supreme Court Chief Justice Ronald Castille doesn't want to add personnel due to budgetary problems.
The Senate Judiciary Committee today approved the nomination of Washington County criminal defense lawyer Phil Melograne to fill the seat left vacant by the death in June of Judge Mark Mascara. The action came even though the county bar association had opposed Mr. Melograne because he does a lot of work in Allegheny and other counties and just joined the Washington Bar Association in July. He said he has lived in Washington county for 10 years.

A 32-year-old man was arrested Saturday after allegedly drinking and driving, in addition to leading a California Highway Patrol officer on a foot pursuit.
The incident ended after 7 p.m. after the man allegedly resisted arrest and a fight ensued with the officer, the CHP reported.
A bulletin had been issued for a drunken driver in the Hilmar area, when CHP officer Dave Anderson spotted a vehicle driven Yovani Nunez Mata, of Denair, said officer John Patterson, CHP spokesman.

The new chief justice of India (CJI) started his stint in the Supreme Court a few months ago with a strict code for the indolent babus. Some appeals are filed after a delay of a thousand and one nights. He has ordered investigation into the delays in some gross cases. His campaign is expected to nudge bureaucrats to move appeals faster. On the part of the assessees, the CJI has insisted on them paying a substantial part of the tax demand before hearing their late appeals.

So you can understand why the Whitman campaign is cranking up the outrage over a choppy, semi-audible voice-mail message that captured an unwitting Brown, thinking he had already hung up the phone after a conversation with a police union official, talking frankly with campaign aides. Long fight for justice
Almost six years after Mark Wright was killed in a workplace explosion the case has still not come to court.
Wright suffered horrific burns in April 2005 after compressed butane aerosols exploded in a crushing machine he had been instructed to operate at the Deeside Metal works in Cheshire.

RBS Asks Judge to Reverse Changes to Liverpool Board

Oct. 12 (Bloomberg) -- Royal Bank of Scotland Group Plc asked a London judge to reverse changes to Liverpool’s board that would block the soccer club’s planned sale to New England Sports Ventures LLC for 300 million pounds ($474 million).
Owners Tom Hicks and George Gillett have sought to halt the sale of Britain’s most successful team, saying the price is too low. Fans have protested their ownership and RBS says the Americans breached their contract when they tried to replace independent board members who approved the sale.

How much can we blame on state pensions?
Wondering why New Jersey isn't finishing its much-needed commuter tunnel to New York? Easy, says David Brooks. Blame public employees, their pensions and their pay. "States across the nation will be paralyzed for the rest of our lives because they face unfunded pension obligations," he writes.
State pension systems are a problem. But they're not the problem right now . And they're certainly not what's standing between New Jersey and its tunnel. After all, Christie didn't fund the pension system this year. He simply skipped the $3.1 billion payment, saying he wouldn’t add money to a "broken" system. If I didn't buy lunch today, you can hardly blame the cost of my lunch for the fact that I don't have bus fare.

A candidate for the U.S. House said Monday that Procter & Gamble Co. told him he would have to quit his job if he wanted to run for Congress.

The legal battle over the ownership of Liverpool got under way yesterday as the saga took a new twist with an increased offer for the Premier League club from a Singaporean billionaire. In the High Court in London, Liverpool’s current American owners Tom Hicks and George Gillett were accused of trying to “frustrate” the club’s sale to the owners of the Boston Red Sox baseball team. Shortly after the hearing began, Singapore tycoon Peter Lim confirmed he had made a rival bid of 360mn pounds ($574mn) to help Liverpool “regain its position at the pinnacle of English and European football, where it truly belongs”. The package is 20% higher than the proposal of 300 mn pounds made by Red Sox owners New England Sports Ventures (NESV) which was accepted by the club’s management last week. However, it appears that Lim’s bid does not offer any more money to Hicks and Gillett. Liverpool chairman Martin Broughton’s decision to sell to NESV is now being contested by Hicks and Gillett, whose three-year reign at the club has been widely unpopular with supporters and has coincided with a lack of success on the pitch. Broughton claims that when the owners decided to sell the club in April, major creditor Royal Bank of Scotland (RBS) requested undertakings that only he, as independent chairman, could make changes to the club’s board. Hicks has denied that any such undertakings took place and that therefore Broughton’s actions in forcing through the sale to NESV were illegal and invalid. In the opening exchanges at the High Court, Richard Snowden, a lawyer representing RBS, accused Hicks and Gillett of trying to change the running of the club to block the sale to NESV. He said this was in order “to frustrate the sale necessary to repay the bank 200mn pounds by this Friday”, the deadline for the repayment of the loan that the Americans took out to buy the club in 2007. The lawyer said the American owners now admitted “a calculated breach of contract” by trying to change the constitution of the companies and the boards involved with the bank’s consent. Hicks and Gillett stand to lose 144mn pounds between them if the 300mn-pound sale to NESV goes through. Lim’s offer values the club at 320mn pounds and he has pledged a further 40mn pounds to buy new players. “I respect and admire Liverpool Football Club, which is steeped in tradition and history,” said Lim, 57, a self-made fishmonger’s son whose fortune is estimated by US business magazine Forbes at 1.6 bn dollars. “I am committed to rebuilding the club so that it can soon regain its position at the pinnacle of English and European football, where it truly belongs. This is why I have stepped forward with this offer,” he added in a statement. The new offer is in cash and will remove the entire acquisition debt of 200mn pounds taken on by the existing owners. Lim said: “My offer provides a firm financial platform from which the club can rebuild. Given the manner in which the sale process has been handled, I feel Martin and the Board owe it to me, to the club and to the supporters to consider my offer.” As the boardroom battle has reached a peak, Liverpool have made their worst start to a season for nearly 50 years.

Trustee: Hecker had $200K as taxpayers paid his lawyers
At a time when Denny Hecker claimed to be too broke to pay for a lawyer and was being represented at taxpayer expense, he had access to more than $200,000, mostly in "stolen" funds, for his lavish lifestyle, the trustee in the former auto mogul's bankruptcy case said in a court filing today.
Unless Hecker is incarcerated, he will continue to "take wrongful advantage of every possible situation" and continue to "waste" money meant for creditors, the trustee, Randy Seaver, said in the legal memorandum. Hecker also should be required to repay the taxpayer money used for his defense before his former private attorney, Bill Mauzy, can be reinstated, Seaver said.
