Welcome to the Texas Intellectual Property Law Journal (TIPLJ). Articles appearing in the Journal focus on substantive legal issues and recent developments in the areas of patent, copyright, trademark, unfair competition, and trade secret law. The Journal also publishes articles concerning issues arising in intellectual property litigation and practice before the Patent and Trademark Office. Kasab did not get a fair trial: Lawyer

Mumbai: Pakistani terrorist Ajmal Amir Kasab will be advised to appeal in the Supreme Court against his death sentence the Bombay High Court confirmed on Monday for his role in the 26/11 attack, his lawyer Farhana Shah said.

'We will certainly advise Kasab on filing an appeal in the Supreme Court when we meet him,' Shah said.

SAN DIEGO — Four people convicted in connection with a $55 million mortgage fraud scheme were sentenced to prison in federal court Friday.

Decision to toss lawsuit against San Bernardino upheld by appeals court - San Bernardino County Sun

A federal court's decision to toss a lawsuit by a company claiming it was discriminated against by the city of San Bernardino was upheld Thursday by the U.S. 9th Circuit Court of Appeals in Pasadena.

"It's a big win for us," said City Attorney James F. Penman. "They were demanding $14 million (to settle) this lawsuit." A federal court in 2008 threw out the lawsuit by Alvarez and Associates, a development and contracting company run by Jaime Alvarez and daughter Marisela Labastida. The company worked with the city's Economic Development Agency on a low-income housing project in the 1990s.

More Paxil Cases Reportedly Set for Court

Houston, TX: Although many Paxil birth defects lawsuits have been settled, there are still some Paxil side effects lawsuits pending. Some of those lawsuits, alleging Paxil defects injured newborn babies, could go ahead this year.

Five Paxil birth defects trials are reportedly set to go to trial in May 2011. The lawsuits allege that GlaxoSmithKline, maker of Paxil, failed to adequately warn about the risk of Paxil to newborn babies. These lawsuits are not the first Paxil birth defects lawsuits to go to trial.

Report: Texas tort reform a success

AUSTIN, Texas (Legal Newsline) - A legal reform group says legislation passed in 2005 to help Texas courts deal with asbestos and silica lawsuits has been successful.

The Texas Civil Justice League on Tuesday released a report, calling the legislation a "Texas success story." The law required plaintiffs to show certain medical evidence to move their lawsuits to an active docket and also asked judges in two multidistrict litigation courts to provide progress reports last year.

Brian Hounshell’s prosecutor, former Arizona Attorney General Grant Woods, said that Hounshell, once convicted of felony corruption, would lose all his political influence: no one will listen to him anymore. 

This prediction I believe justified his lenient treatment of Hounshell in the face of dozens of charged and uncharged acts of his corruption and lying involving a great deal of money and public property.  Fortunately for some and unfortunately for others, Mr. Woods’ prediction has been proven wrong. 

Judge to consider Twitter information request

A U.S. federal judge on Tuesday said she would consider an order that the social networking site Twitter must turn over three clients' personal information as part of the government's criminal investigation into WikiLeaks founder Julian Assange.

Half a dozen lawyers for the three Twitter customers -- including Assange -- argued that their clients' information is protected by the First Amendment.

Given the minuscule government budget allocated to local musical ensembles, there will surely be some people who will be unhappy about this: Many advocate the "divide and conquer" ideology that seeks to close down orchestras or at least combine a few together, so that the meager funding available does not have to be spread among too many. Who needs another orchestra here, they say, when the existing ones are starving to death? On the other hand, some people are skeptical about the assumption that reduction of the number of entities will actually increase the share allocated to the remaining bodies - because who can guarantee that the budget will remain at its original level should the number of institutions it supports drops?

A high-level Atlanta Public Schools official allegedly advised principals to refuse to cooperate with a criminal cheating inquiry, instructing them to write notes telling state investigators to “go to hell.”

A troubled dentist who pleaded guilty Friday to illegal distribution of steroids and human growth hormone had issued prescriptions for performance-enhancing drugs to clients that included the founder of Orange County Choppers and at least four Major League Baseball players, business records show.

The case, prosecuted in South Florida, has ties to a steroids-distribution investigation launched four years ago in Albany.
