Medical Board OKs Doctor's Settlement

Dr. Clinton Christopher Pittman will pay $5,000 and do 50 hours of community service as penalties for doing kyphoplasty at the wrong place on the spine in July 2009.

Pittman, now practicing in Tampa, was with Radiology and Imaging Specialists in Polk County when he did the procedure at Winter Haven Hospital.

The interventional radiologist also will give a one-hour lecture on wrong-site surgery, reimburse the state for investigative costs and take five hours of medical education in risk management.

In approving those conditions Saturday, the Florida Board of Medicine accepted the settlement proposed by Pittman and the Florida Department of Health.

The error occurred despite Pittman's having followed a recommended "time out" safeguard — pausing before the procedure to confirm the patient's identity, the intended procedure and the correct surgical site.

His lawyers said the area Pittman treated had a problem more prominent than the one on the area intended for kyphoplasty.
