Mining protesters appeal W.Va. restraining orders

CHARLESTON, W.Va.

Holding up a photo of a mountaintop removal coal mining site, a lawyer for environmentalists urged West Virginia's Supreme Court on Tuesday to intervene in a lower court's orders barring protesters from Massey Energy Co. operations.

The lawyer, Roger Forman, said the Raleigh County Circuit Court orders were too broad and could potentially apply to the justices themselves or anyone else.

The recount process was now in its fifth week. Unknown at the time, the Franken-Norm Coleman election would turn at this December 12 meeting when the Board, reversing an earlier decision, opted to allow a review of previously (and wrongly) rejected absentee ballot envelopes. Those rejected envelopes were now being referred to as "the fifth pile"; there were four statutory reasons to reject absentee ballot envelopes, and the "fifth pile" was for ballots turned down by election officials for no lawful reason.

Hasan has hearing today in Fort Hood shooting case

Democrat White calls for campaign finance limits

AUSTIN, Texas — In a state known for its high-dollar political donations, Democrat Bill White is calling for limits on the size of contributions to candidates for governor. But he still hasn't figured out how much is too much.

White, trying to unseat Republican Gov. Rick Perry, said Monday he would bring both parties together to draft appropriate campaign finance limits. He also renewed his call for limits of $10,000 from people the governor appoints to state boards and commissions.

A federal court jury being selected today will consider claims by seven FMC Technologies employees that nooses found hanging at a plant symbolized discrimination and a hostile environment within the oil and gas equipment company.

The seven, including six African-Americans and one West Indian, also allege in their lawsuit that co-workers used racial slurs and that complaints to human resources were ignored. Jury selection is set to begin today before U.S. District Judge Kenneth Hoyt, for a trial expected to last about four weeks.

The British Columbia Court of Appeal will rule Tuesday on whether a former sex worker can challenge the Criminal Code to decriminalize prostitution.

For the past three years, the former sex worker, Sheri Kiselbach, and a team of lawyers have tried to overturn parts of the Criminal Code in an attempt to protect the lives of prostitutes. Although prostitution is technically legal in Canada, it is considered a crime to operate a bawdy house, communicate in public to sell sex or live off the avails of prostitution. Sex workers and activists say these limits endanger the lives of the women who work the streets in often dangerous conditions.

RTÉ News: Court reserves judgment in Dunbar appeal

The court of criminal appeal has reserved judgment in an appeal by Ronnie Dunbar against his conviction and sentence for the manslaughter of 14-year-old Melissa Mahon in 2006.

The 45-year-old from Rathbraughan Park, Sligo, who is also known as Ronald McManus, was sentenced to life in prison in July last year after a jury found him not guilty of murder but guilty of manslaughter of the Sligo schoolgirl.

Human rights activists around the world have called for international justice and an end to impunity in the wake of the “U.N. Mapping Report on Human Rights Abuse in the Democratic Republic of Congo.”

The report, which covers the period from 1993 to 2003, was released on Oct. 1 by the Office of the United Nations High Commission for Human Rights. U.N. High Commissioner for Human Rights Navi Pillay says that, though it covers a time period ending in 2003, these crimes continue because the perpetrators have never been prosecuted.

Special court throws out Keller rebuke, ending case

A special court of review Monday threw out an ethics rebuke given to Presiding Judge Sharon Keller for closing the Court of Criminal Appeals at 5 p.m. despite knowing that lawyers wanted to file an appeal for an inmate facing imminent execution in 2007.

Ruling not on the merits of the case but on the way it was handled, the three-judge panel also threw out the charges that accused Keller of violating her duty as a judge and prohibits the State Commission on Judicial Conduct from refiling the accusations.

TALLAHASSEE, FLA—The Florida Supreme Court in recent court orders disciplined 18 attorneys, disbarring six and suspending eight. Some attorneys received more than one form of discipline. Judge to weigh in on hospital lawsuit - GreenwichTime

STAMFORD -- The lawyer for a group of women involved in a class-action lawsuit against Greenwich Hospital want a judge to uphold a portion of their claims arguing the hospital used deceptive and unfair trade practices that caused them to lose money.

But the hospital has asked a judge to strike two major counts of lawsuit from the record, arguing the plaintiffs do not make a "cognizable claim" under the Connecticut Unfair Trade Practices Act (CUPTA).

A North Naples man faces his second drunken driving charge after leading deputies on a two-mile chase at speeds of up to 100 mph as he fled to his home Saturday night, deputies say.

James Michael Livingston, 29, of the 100 block of Wading Bird Circle, allegedly reached for Cpl. Ralph Scala's holster as he pushed him to the ground, began crying and told Scala and Deputy Jason Stauffer, "You have nothing on me," according to his arrest report.

JACKSON, MISS—A Mississippi lawyer has been jailed after a judge found him in contempt when he declined to recite the pledge of allegiance.

Chancery Judge Talmadge Littlejohn jailed attorney Danny Lampley, 49, on Wednesday.

Lampley was in court representing a client in a divorce case.  He was released after spending about five hours in jail so he could represent another client, according to the judge.

Transocean Ordered to Pay $4M for Louisiana Worker's Injury

A federal jury has ordered Transocean to pay more than $4 million in damages to an oilfield worker injured in an offshore rig accident.

The recent judgment capped a trial for the lawsuit that 32-year-old Dan Averette filed over the July 14, 2007, accident aboard the Amirante, a rig owned by Transocean Enterprise Inc. and operated by Transocean Offshore Deepwater Drilling Inc.

Today's guest blogger is Lester Brickman , Professor of Law and former Acting Dean at at the Benjamin N. Cardozo School of Law.

The dispute over the growth of tort liability and whether this has resulted in a “litigation explosion” transcends mere statistical jousting.  Invariably, those who conclude that there has been explosive growth in tort litigation support reforms to roll back excessive tort liability expansion.  Conversely, those who reject the explosive growth thesis also reject tort reforms as unnecessary and unwise.  In the tort reform wars, the battle over whether there has been a substantial increase in the scope of tort liability and resulting “explosion” in litigation, as measured by the volume of tort litigation, looms large.  The accepted wisdom, of course, is that the claim of a “litigation explosion” is pure bunk.  Not so fast.

'Increase in pre-nuptial awareness'

Almost half of young people may demand pre-nuptial agreements before getting married, according to research published.

"Prenups" are no longer the exclusive territory of the rich and famous, lawyers said, as research showed 44% of 18 to 24-year-olds would consider them.

Divorcees heading for a second marriage were also likely to make arrangements, with 42% of 45 to 54-year-olds saying they would think about them, according to a OnePoll survey of 1,000 people for law firm Dawsons LLP.

Some two thirds of popular Apple iPhone applications transmit users UDIDs, leading to potential security concerns, a new study has warned.

Eric Smith, Assistant Director of Information Security and Networking at Bucknell University in Lewisburg, Pennsylvania, discovered 68 per cent of the 57 top applications in the Apple iTunes App Store sent out UDID information, back to a remote server, owned either by the application developer or an advertising partner.
